Τόμας Λουμπάνγκα Ντυίλο: το χρονικό μιας προαναγγελθείσας δίκης

Abstract

Οι εξελίξεις στην υπόθεση Λουμπάνγκα συνεχίζουν να εκπλήσσουν. Παρά την αρχική απόφαση του Διεθνούς Ποινικού Δικαστηρίου (ΔΠΔ) για την απαλλαγή και απελευθέρωση του κατηγορουμένου λόγω του ανέφικτου διεξαγωγής μιας δίκαιης δίκης, τελικά το Τμήμα Εφέσεων αναίρεσε πρόσφατα την παραπάνω απόφαση. Επιπλέον, λιγότερο απροσδόκητα στη συνέχεια το Α΄ Τμήμα Πρώτου Βαθμού, στο οποίο αναπέμφθηκε η υπόθεση, αποφάσισε την έναρξη της ακροαματικής διαδικασίας στις 26 Ιανουαρίου του 2009.

The evolution of the Lubanga case continues surprising everyone. Despite the Trial Chamber I of the International Criminal Court (ICC) initial decision for the stay of proceedings and release of the detainee due to the impossibility of a fair trial process, the Appeal Chamber eventually ruled that the Trial Chamber`s decision was erroneous because it "failed to take the conditional character of the stay it had imposed properly into account". A little later and less unexpectedly the Trial Chamber lifted the stay of proceedings, ordered the prosecution to disclose all the items of evidence to the defence and scheduled the trial’s commencement in 26 January 2009.
